Terms of Service

These Terms govern your use of the KreativeRock platform, operated by KreativeRock Digital Limited (RC 1441363), Lagos, Nigeria ("KreativeRock," "we," "us"). By creating an account or using our platform, you agree to these Terms.

1. What we provide

KreativeRock provides business messaging and AI automation tools — SMS, WhatsApp, RCS, and an AI Sales Assistant — that let you communicate with your own customers. You connect your own sender identity (a WhatsApp Business Account, a Sender ID, etc.) and use our platform to send and manage messages on your own behalf.

2. Your account

You must provide accurate information when signing up, and keep your login credentials secure. You're responsible for all activity that happens under your account.

3. Acceptable use

You agree not to use KreativeRock to:

• Send messages to anyone who hasn't consented to receive them.
• Send spam, phishing attempts, or content that violates WhatsApp, SMS carrier, or RCS provider policies.
• Send unlawful, fraudulent, defamatory, or harassing content.
• Attempt to circumvent any messaging platform's opt-in, opt-out, or rate-limit rules.

You are solely responsible for having a lawful basis and proper consent to message your own contacts. We may suspend your access if we reasonably believe you're violating this section or putting our platform's standing with a messaging provider at risk.

4. Credits and billing

Sending messages consumes credits from your KreativeRock credit balance. Credits are purchased in advance or, where offered, consumed as you send. Prices are shown before you send. Credits are non-refundable except where required by law or expressly stated at the point of purchase.

5. Your content

You retain ownership of the content you send and the data you upload (contacts, Knowledge Bank entries, etc.). You grant us a license to process it solely to provide the service to you — we don't use your data to train models for other customers or sell it to third parties.

6. Service availability

We aim for high availability but don't guarantee uninterrupted service. Some features depend on third parties (Meta's WhatsApp Business Platform, SMS aggregators, RCS providers) whose own outages or policy changes are outside our control.

7. Termination

You may stop using KreativeRock at any time. We may suspend or terminate your account for violating these Terms, non-payment, or if required by a messaging platform's own policies. We'll try to give notice where practical.

8. Limitation of liability

To the extent permitted by law, KreativeRock is not liable for indirect, incidental, or consequential damages arising from your use of the platform, including message delivery failures caused by third-party messaging providers.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the platform after an update means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria.
